Mark R. Maltsberger attended Texas A&M University and graduated with a Bachelor of Arts in Speech Communication in 1997. While attending A&M, he was a proud member of the Fightin’ Texas Aggie Band. Mark received his Juris Doctorate in 2000 from the South Texas College of Law. After being licensed, he served as an Assistant District Attorney in Brazoria and Walker counties for three years, was an Adjunct Professor in Business Law for Lee College and Sam Houston State University, and in private practice in Huntsville for another six years.

Mark returned to Aggieland in 2009 and opened the Law Office of Mark Maltsberger in 2010. The majority of Mark’s practice consists of representing clients accused of criminal offenses. He also advises clients in probate, guardianship, and child protection matters. He has twice been recognized as Attorney of the Year by Lone Star Legal Ad for his dedication to Pro Bono services in Brazos County. Mark is involved in the Brazos County community. He serves as an officer for MHMR Authority of the BrazosValley, a Director of the Texas Aggie Band Association, a youth sports coach, volunteers as a high school Mock Trial judge, and is an active member and supporter of many other community organizations Mark lives in College Station with his wife, Christen (class of 1997), daughters, Mary Katherine and Anna Claire, and sons, Grant and James.

I am honored to be a candidate for Judge of Brazos County Court at Law No. 2.

I have served Brazos County as a lawyer, a community volunteer, and a dedicated Republican. I am a conservative who believes judges must interpret the law—not rewrite it—and apply it fairly, consistently, and without bias.


My education and professional experience have prepared me well to serve as judge. I am an Eagle Scout and National Merit Scholar. While attending Texas A&M University, I was awarded a University Endowed Scholarship and the Commandant’s Leadership Scholarship and proudly served as a member of the Fightin’ Texas Aggie Band. I graduated in 1997 with a Bachelor of Arts in Speech Communication.


I earned my Doctor of Jurisprudence from South Texas College of Law, was licensed to practice law in Texas in 2000, and admitted to practice before the U.S. District Court for the Southern District of Texas in 2005.


As an attorney, I have served in a wide range of roles. I worked as an Assistant District Attorney in Brazoria and Walker Counties and was appointed Special Prosecutor in Madison and Grimes Counties. In private practice, I have represented countless clients in courts across the State of Texas, handling a broad spectrum of cases with professionalism and integrity.


I am deeply committed to the community where I live, work, and raise my family. Seeking election as Judge of County Court at Law No. 2 is the next step in a lifetime of service. Throughout my career, I have advocated for some of our most vulnerable citizens—children, indigent individuals without access to justice, and those with mental illness or developmental disabilities who cannot advocate for themselves.


Justice Lewis Powell once wrote:
“Equal justice under law is not merely a caption on the façade of the Supreme Court building; it is perhaps the most inspiring ideal of our society… It is fundamental that justice should be the same, in substance and availability, without regard to economic status.”


I strive to live out that principle every day. I regularly represent indigent clients, and in recognition of this work, Lone Star Legal Aid named me Pro Bono Attorney of the Year in 2021 and honored me in 2019 for handling the most contested pro bono cases in Brazos County.


Individuals with developmental disabilities and mental illness are too often pushed to the margins of society—that is simply wrong. Through my service on the Board of the MHMR Authority of Brazos County, I work to ensure these individuals receive the services and support they need to live with dignity. I have also successfully obtained verdicts of Not Guilty by Reason of Insanity for two clients charged with murder who were not receiving appropriate mental health treatment; today, both receive care in state mental health facilities.
